State Taxes

Quote from Qoztek on March 27, 2025, 11:52 amI'm getting mixed messages in regards to State Income Tax.
On one hand, the current states are departments of the federal government, according to the Comprehensive Guide, which means that a national isn't required to pay them taxes.
On the other hand, all the instructions in this website specify federal income tax, as opposed to state income tax. Also, some state websites seem to indicate that nonresident aliens still are required to pay state income tax. This means that a national is required to pay them.
Does anyone have any clarification on this?

Quote from David on March 27, 2025, 2:00 pmI believe that state income tax is based on income that is taxable by the federal government. Since as a nonresident alien one does not pay federal taxes on income (other than for 26 CFR 871(b) & 877(b), then the state should fall in line. Make sure you notice your state revenue department with your affidavit as you do with other agencies.

Quote from Rebal on May 3, 2025, 12:01 pmI would like more information on State Taxes
I submitted my Eviden of Citzenship paper work to the SoS in 2016 but I never notified the state.
I got my passport and didn't think twice about anything after that, well all these yrs later I recieved a letter from Montana Revenue Service regarding State tax due for the years 2016, 17, 18 and 2020
They skipped a year since they took out a lot of money in 2019. Now they claim I owe $3500 and that amount is climbing every month. They took money out of my paycheck but they have not accounted for it, probably because it was under the amount they estimate I "owe".
I sent them my paperwork and they say it doesn't matter that I'm not a citizen I still have to pay Montana state tax.
They're saying the amount they claim I owe is an estimate and as soon as I file that amount maybe reduced. Interesting thing is I haven't filed taxes since 2016 but they are only concerned with 2016, 17, 18 and 2020.
They have been taking money out of my check since 2016 and I don't know how to get them to stop.
Your expertise in this matter would be appreciated
Thank you
Rebecca
