STEP THREE: Passport Application

Warning

You should have already completed, notarized, and mailed your affidavit of citizenship evidence to the U.S. Department of State and mailed your notices. If not, go back and complete Step One and Step Two.

Apply for a new or renew your passport book and card.

It is very important to acquire a new or renew your passport book and card. The reason for the importance of this is that your newly reclaimed status as a national is connected to it. Albeit your new passport book and card will not clearly indicate your status as a national, your status will be a part of your electronic record with the U.S. Department of State and consequently with other government agencies such as the USCIS, the Department of Homeland Security, and the Social Security Administration. This will become apparent when you’re able to separate yourself from the federal tax system later in your journey to freedom. It is not in their interest to openly acknowledge or illustrate your status as a national, as it represents your separation from their system of servitude.

Your passport book and card, in addition to a copy of your previously submitted affidavit, can be and should be utilized as primary means of identification to demonstrate your status as a national to government officials. Government officials will have the means to look this up, but most likely will not share with you what or how it is presented to them. If they can’t, you’ll have your affidavit, which has been acknowledged by the U.S. Department of State, at hand to show them if needed. Most will just go mute. There will be more on this later, but just know that your status as a national will be connected to your passport.

1. Download, or complete online then download a DS-11 (new) or DS-82 (renewal) U.S. Passport Application, whichever applies to your situation.

  • Use the DS-11 (https://eforms.state.gov/Forms/ds11.pdf) if you’ve never had a passport or your old passport is over 15 years old.
  • Use the DS-82 (https://eforms.state.gov/Forms/ds82.pdf) form to renew your old passport if it is less than 15 years old. Return your old passport and old passport card with your passport renewal application and your Affidavit of Citizenship Evidence.
  • It is recommend that you order both the new passport book and the passport card, if your budget allows.
  • The DS-11 and the DS-82 both have the same declaration that you’ll need to agree to when you sign the application. Both will refer you to the “warning” box on page four of the instructions. In the warning box it indicates that you can attach an affidavit to the application (this will be your Affidavit of Citizenship Evidence) even though it is not specific to this in the warning.

2. Gather your passport application DS-11 or DS-82 documents and include the following in your mailing package:

  • An original, notarized Affidavit of Citizenship Evidence and cover letter.
  • Include your old passport book and/or passport card, if submitting the DS-82 renewal application.
  • Send a certified copy of your birth certificate with the DS-11.
  • Money order or certified check for the fees.
  • Do not staple documents together. Use a paper clip to hold them together prior to putting them into the envelope for mailing.

3. Mail certified mail, return receipt.

  • When you receive the green card back, place it in a secure location.

On page 1 (signature page) of the application, there is a statement regarding declaring your political status.

The statement appears to force an applicant to agree, under threat of perjury, that they are limited in identifying themselves as a citizen or non-citizen national of the United States. Neither of these statuses are the status that apply to a “National” (Section 101(a)(21) of the INA or 8 USC 1101(a)(21)).

So how does the application allow a “National” to apply for a passport and not perjure themselves? See number 5 (highlighted) in the statement that you’re agreeing to under threat of perjury. It reads, “I have read and understood the warning on page 4 of the instructions to the application form.”

  • The warning box allows for the attachment of affidavits, that’s how you will notify them of your new political status.
  • Notice the WARNING box is in both the original and renewal application. The reason? Because we are in the feudal system. In that system a voluntary serf can volunteer OUT at any time. Even if one’s great, great grandparents were the ones who volunteered IN to the condition. A person born into that condition in any subsequent generation can volunteer OUT!

Keep in mind, that as a national, you will also need to send a copy of your affidavit of citizenship evidence with DS-82 and a certified copy of your birth certificate and your affidavit with the DS-11.

When you get your passport book and card back from the U.S. Department of State, take a look at the page in the book that is illustrated below. This image illustrates what is printed inside the passport book. It is not indicative of the exact status that is associated with your individual status, but it does represent that the U.S. Department of State recognizes the national status along with the U.S. citizen status. You won’t see a similar indicator on the passport card.

8 FAM 505.2 PASSPORT ENDORSEMENTS
The Foreign Affairs Manual (FAM) and associated Handbooks (FAHs) are a single, comprehensive, and authoritative source for the Department’s organization structures, policies, and procedures that govern the operations of the State Department, the Foreign Service, and, when applicable, other federal agencies. The FAM (generally policy) and the FAHs (generally procedures) together convey codified information to department staff and contractors so they can carry out their responsibilities in accordance with statutory, executive, and department mandates.

An interesting section of the FAM provides detailed information about passport “endorsements”.

Endorsements on a passport card are numbers that presumably indicate certain aspects of one’s political status.

Although the list is quite extensive, the information provided does not clarify where the numbers exactly are on the passport card. This information must be internal to Department staff and contractor.

Confirmation of acceptance and acknowledgement of your status as a national.

In Step One of this process, you mailed your affidavit of citizenship evidence and its cover letter to the U.S. Department of State. You would have expected some sort of acknowledgement that they received your documents. Or perhaps you’d get some sort of congratulations that you’ve reclaimed your national political status. Interestingly, when someone becomes a U.S. citizen, they will receive congratulatory mail to them from the U.S. Department of State. What you’ll probably discover, though, is that you will not get any correspondence back acknowledging their receipt other than your return certified mail receipt. This certified mail receipt, indicating they signed for it, actually provides you the confirmation of their receipt of your documents. Keep it in a safe location.

You will receive a new passport book and card from the U.S. Department of State. The passport book and card will not show any indication that you’re now under the national political status, but the fact that they processed your application and returned a passport to you indicates it was acknowledged. Additionally, they will mail back to you the copy of the affidavit of citizenship evidence that you attached to the passport application and your old passport book and/or passport card (if you submitted a renewal DS-82). The envelope will only contain a copy of the affidavit of citizenship evidence with no explanation but will have a 12-digit file number typed in the top right corner.

We aren’t sure what their file numbering system is, but it definitely indicates they’re tracking it. Your old passport book and/or card will have holes punched in them to invalidate them for use. Keep the copy of the affidavit of citizenship evidence that has the file number on top and your old book and/or card in a safe location also.

Optional Confirmation Method

If you want additional verification that they’ve received and filed your documents, you can submit an online request at U.S, Department of State – Freedom of Information Act. Choose the Privacy Act selection as it includes the FOIA.

After you register on their site, you can submit the Privacy Act/FOIA request. Fill out the request form fields with your name, address, etc. Below is an example of the verbiage that you could enter into the Records Description field on the form. You should also enter your demographics into this field, even though you already did so previously on the form.

It can take several weeks for them to reply, but you will eventually receive copies of your application and affidavit of citizenship evidence, showing it’s in their system. It will not indicate your corrected status to national. You can track the progress of your request on their Privacy Act/FOIA request page (PAL).

We believe that this is a bluff letter; we have just ignored it as it does not apply to national status. Essentially, it is a distraction.   • Notice the WARNING box is in both the original and renewal applications. The reason? Because we are in the feudal system. In that system, a voluntary serf can volunteer out at any time.   • It is strongly advised that anyone who can afford it purchase a passport and a passport card. The reason for this? You then have the highest recognized form of federal government identification available. It is literally attached to your submitted citizenship evidence. You will not be able to tell that there is any difference in your new passport, even from a close inspection. However, your new status is identified in their system. We have been told that people who have submitted citizenship evidence paperwork are classified as diplomatic couriers in their system. This is hearsay evidence. We have no solid proof for that statement; none of us have Top Secret clearance to see such information. However, it would be legally correct that a diplomatic courier would have the same privileges and immunities as the original state citizen.
  • You can expedite your passport application. There is an extra fee for doing so. Should you pay to expedite your application processing, be sure to put dates of travel on the form. Otherwise, it goes to the bottom of the applications for expediting and will not process any faster than a normal application.
  • When you submit your passport application and associated documents, you can actually track your application online to see where it is in the process. We do not have the web address, but you can call the State Department at 1-800-877-8339. They will tell you how to track your application. Should you follow up in this manner, be sure to notice in the State Department’s own language, it states several times, the term citizenship EVIDENCE. Believe me, the legal department at the Department of State knows what the word evidence means.

When the passport application was submitted to the U.S. Department of State, it included the affidavit of citizenship evidence. Once the application was processed, the original copy of the affidavit was returned to me. But interestingly, they had stamped a number at the top right corner of the document. It is assumed that this number is an internal U.S. Department of State file number. If so, it would effectively confirm that the submitted affidavit was filed in the applicant’s administrative record. In addition, a Privacy Act/FOIA request was submitted for this writer’s historical passport application documents, and the affidavit came back with the Privacy Act/FOIA response and listed the “file” number on the top of the copy that came back with the Privacy Act/FOIA response.

I don’t have a birth certificate. How do I prove citizenship to get my passport?

You will use the DS-10 birth affidavit
The DS-10 Birth Affidavit is a legal document used to establish U.S. citizenship for individuals who do not have an acceptable birth certificate. It serves as a secondary form of evidence of U.S. citizenship, providing a written statement by a witness to the birth circumstances. Download the form here.

Purpose:

  • To confirm the birth of a U.S. citizen in the United States
  • To provide alternative evidence of citizenship when a birth certificate is unavailable or unacceptable
  • To accompany a passport application when an acceptable birth certificate cannot be submitted

Components:

  • A written statement by the affiant (witness) describing the birth circumstances
  • Identification information for the affiant
  • Information about the applicant’s birth, including date, place, and time
  • A declaration by the affiant that they have personal knowledge of the birth facts

Acceptable Affiants:

  • A parent or guardian who was present at the birth
  • A doctor, nurse, or other medical professional who attended the birth
  • A government official or other authorized individual with knowledge of the birth

Submission Requirements:

  • The completed DS-10 Birth Affidavit form
  • Supporting documentation, such as early public records or other evidence of citizenship
  • A passport application (Form DS-11)

Note: The DS-10 Birth Affidavit is not a substitute for a birth certificate but rather a supplementary document to establish U.S. citizenship. It may be used in conjunction with other evidence, such as early public records or hospital records, to confirm citizenship.

Do I have to send my old passport in with my renewal application?

Yes, you will have to mail it in with your renewal application. But what they normally do is mail it back before they send you your new passport. So you shouldn’t be without it for very long.

Do I need a cover letter with my passport application?

No, you don’t need a cover letter for the passport application, but you should send a copy of your affidavit of citizenship evidence and a copy of the affidavit cover letter along with the passport application.

      Hi Brian and thank you for your question. The goal for acquiring a new passport is to associate your national political status with the highest level of identification offered by the federal government, the passport. I have not seen any proof from official U.S. Department of State documentation that states the meaning of the stars or the significance of how many there are on the passport card. There may be a meaning, but they don’t openingly disclose it to the masses. Here is a link to a document that discusses the specifics of the passport. It doesn’t mention the stars.
