Passport Rejection Letter

If you've completed all the prerequisite steps as mentioned above, then I wouldn't accept either of their options in their letter. I'd attach to your own letter back to them reminding them of the correct code and attach copies of your previous documents you've submitted in the process you've completed to declare your national status.
First, did you complete all steps involved in the overall process...submit affidavit to US SOS, notices, and attach copy of your affidavit to the passport application? If not, this may be why you got the "bluff" letter. Be aware that they're referencing the incorrect US Code. They're using 8 USC 1101(a)(22)A&B. As a national, the correct code is 8 USC 1101(a)(21).
